Scope of Services
Mark Tottenham’s services are limited to the provision of professional and practical consultancy in relation to expert witness practice and the use of expert evidence in litigation. This may include guidance on procedural matters, professional standards, preparation for expert work, and related issues as agreed with the Client.
Mark Tottenham shall not provide legal advice, advocacy, or representation, and nothing in his services should be relied upon as a substitute for advice from qualified solicitors or counsel.
Duties and Independence
Any guidance provided is of a general and advisory nature. Responsibility for decisions taken, instructions given, and compliance with legal and professional obligations remains with the Client and/or the expert witness concerned.
Overriding Duty to the Court
Nothing in the services provided shall suggest, or be construed as suggesting, that an expert witness should depart from or compromise his or her overriding duty to the court, tribunal, or other decision-maker, or breach any legal or professional obligation.
Fees
Fees will be agreed in advance, whether on an hourly, fixed-fee, or other agreed basis. Invoices will be rendered in accordance with agreed terms.
Limitation of Responsibility
While Mark Tottenham will exercise reasonable skill and care in providing his services, he does not accept responsibility for the outcome of any litigation, arbitration, or dispute, nor for the content of any expert report, evidence, or testimony produced by others.
Confidentiality
All information provided by the Client will be treated as confidential, subject to any legal or professional obligations requiring disclosure.
Governing Law
This retainer shall be governed by and construed in accordance with the laws of Ireland.
